Why is my real estate license cancelled

Each state grants real-estate licenses to qualified candidates who follow a prescribed course of study and pass a certification examination. The valid period for these licenses varies by state; California issues its real-estate licenses for four years and allows real-estate salespeople to carry out the functions of their field, including representing buyers or sellers in real-estate transactions. The license is subject to a complex set of regulations and standards, and can be suspended by the Department of Real Estate for a number of causes. Suspensions and revocations have increased in recent years as the state investigates a growing number of people for abuses in short sales and loan-modification scams.

Conditional Suspension

  1. Licensees are required to pass certain real-estate courses, and those holding a real-estate license must pass continuing education classes during the four-year term of their license. A real estate license may be subject to “conditional suspension,” which occurs when a licensee does not submit proof that the required courses have been completed. If the proof of completion is not submitted prior to expiration of the license, then the suspension becomes permanent.

Grounds for Suspension

  1. A license may also be suspended by a decision of the California Department of Real Estate. There are various grounds for suspension, including failure to comply with educational requirements, violation of the law or conduct deemed unethical by the department. A suspension carries with it a term during which the licensee may not perform any function that requires a license.

Child-Support Obligations

  1. California can also suspend real estate licenses for failure to comply with state statute 17520 of the Family Code, dealing with obligatory payments of child support. .

Restricted and Revoked Licenses

  1. Real-estate licenses in California may also be restricted or revoked. An agent may carry out tasks which require a license when restricted, but is effectively on probation under the authority of the California Department of Real Estate. Those holding a revoked license may not carry out any activities that require a real estate license. Grounds for revocation of a license include failure to pay the required license fees.

Suspension of Conditional Licenses

  1. Conditional licenses are issued to real-estate salespeople who are granted an 18-month term within which to complete a course in real estate principles, pass an examination, and complete two additional courses at the college level. If the person holding the conditional license fails to submit evidence of course completion within the 18-month term, the license is suspended. The license may be reinstated if proof of course completion is submitted within four years of the original issue date.

    Estate agents’ licences are perpetual as long as annual statements are lodged and fees are paid. However, licences can be cancelled or voluntarily surrendered.

    Your individual estate agent's licence is cancelled if you:

    • become an insolvent under administration
    • become a represented person within the meaning of the Guardianship and Administration Board Act 1986.

    A company's estate agent's licence is automatically cancelled if it:

    • becomes an externally administered corporation.

    Cancellation after 30 days

    Individual licences

    Unless you apply to the Business Licensing Authority (BLA) for permission, your licence is automatically cancelled 30 days from the date:

    • you are convicted or found guilty of a disqualifying offence involving fraud, dishonesty, drug trafficking or violence punishable by 3 months or more in prison. It must not be a spent conviction within the meaning of the Spent Convictions Act 2021 (Vic) or any equivalent law of a state or territory of Australia or of the Commonwealth.     • you are made the subject of an order by any regulatory body disqualifying you from acting as an estate agent or agent's representative
    • of a successful claim against the Victorian Property Fund, or any corresponding fund.

    Company licences

    Unless a company applies to the BLA for permission, its licence is automatically cancelled 30 days after:

    • one of its directors has their licence cancelled and the BLA notifies them in writing that one of its unlicensed directors is ineligible to apply for a licence
    • it is the cause of a successful claim against the Victorian Property Fund
    • it is convicted or found guilty of a disqualifying offence involving fraud, dishonesty, drug trafficking or violence punishable by 3 months or more in prison. It must not be a spent conviction within the meaning of the Spent Convictions Act 2021 (Vic) or any equivalent law of a state or territory of Australia or of the Commonwealth.     Voluntarily surrendering your licence

    You can voluntarily surrender your licence by writing to the BLA and including your licence. 

    Your licence ends on the day the BLA receives your letter and licence.
